Client Content: You retain all rights to content, images, and materials you provide to us. By providing these materials, you grant us a license to use them for the purpose of completing your project.
Our Work: Upon full payment, you will own the final deliverables created specifically for your project. Kasper Web Design retains the right to use the work in our portfolio and marketing materials unless otherwise agreed.
Third-Party Assets: Some projects may include third-party resources (fonts, stock photos, plugins). Separate licenses may apply to these resources.
We warrant that our Services will be performed in a professional and workmanlike manner. However:
To the maximum extent permitted by law, Kasper Web Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. We will keep confidential any proprietary or sensitive information you share with us during the course of our engagement. This does not apply to information that is publicly available or independently developed.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, strikes, or technical failures.
Any disputes arising from these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Los Angeles County, California, in accordance with the laws of the State of California.
